By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

ASMR AI Studio provides users with advanced AI tools to create original ASMR videos, apply professional templates, and generate content using state-of-the-art AI models including OpenAI Sora 2 and Google Veo 3. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations, including copyright and intellectual property laws.

User Accounts and Registration

Account Creation

To access our AI video generation features, you need to create an account. You must provide accurate and complete information during the registration process, including:

Accurate profile information

Account Security

You are responsible for:

All activities that occur under your account
Notifying us immediately of any unauthorized use or security breach

Video Content and Intellectual Property Rights

Your Generated Videos

Ownership: You retain full ownership of all videos you generate through ASMR AI Studio's AI tools. The videos are your creative property, and you have complete control over how you use them.

Commercial Rights:

Free Plan: Videos include a watermark and are for personal use only. Commercial use is not permitted.
Pro and Lite Plans: You receive full commercial usage rights for your generated videos without watermarks. You may use, sell, distribute, and monetize your videos without restriction.

Attribution: No attribution to ASMR AI Studio is required for your generated videos, regardless of your subscription plan.

License Grant: By generating videos on our platform, you grant ASMR AI Studio a limited, non-exclusive license to display your videos within the platform for operational purposes (such as showing in your dashboard or history).

Uploaded Content

Your Responsibility: You must own or have proper licensing for any audio, video, or other media content you upload to our platform. You represent and warrant that:

You own all rights to the uploaded content, or
You have obtained all necessary permissions and licenses
Your content does not infringe on any third-party rights

Processing Rights: By uploading content, you grant ASMR AI Studio the right to process your media through our AI systems to provide the requested video generation services.

No Training Use: Your uploaded content will NOT be used to train our AI models without your explicit consent. We respect your intellectual property and privacy.

Platform Content

All ASMR AI Studio technology, AI models, software, templates, and platform content remain the exclusive property of ASMR AI Studio
You may not reverse engineer, copy, modify, or redistribute our AI technology or platform code
Our templates, UI designs, and branding are protected by intellectual property laws
Unauthorized use of our platform content may result in legal action

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using ASMR AI Studio:

Uploading copyrighted material without proper authorization
Using the service to create videos that infringe on others' intellectual property
Generating content that is illegal, harmful, defamatory, or violates community standards
Creating videos that promote hate speech, violence, terrorism, or illegal activities
Producing content that exploits or harms minors

Technical Prohibitions

Attempting to bypass usage limits, credit systems, or security features
Using automated tools, bots, or scripts to access the service without authorization
Interfering with or disrupting the service's security, servers, or networks
Attempting to gain unauthorized access to other users' accounts or data
Reverse engineering or decompiling our AI models or software

Commercial Prohibitions

Reselling or redistributing ASMR AI Studio's AI technology without authorization
Using free plan videos for commercial purposes
Sharing account credentials to allow unauthorized access
Creating accounts to circumvent usage limits or pricing

Abuse and Misuse

Using the service for spam, phishing, or malicious purposes
Harassing, threatening, or abusing other users or our staff
Submitting false information or impersonating others
Engaging in fraudulent activities or payment disputes in bad faith

Violation of these prohibitions may result in immediate account suspension or termination, and potential legal action.

Credit System and Usage Limits

Credit Allocation

Free Plan: 15 credits upon signup
Pro and Lite Plans: Credits allocated according to your subscription tier
Each video generation consumes a specific number of credits based on:
- Video length and complexity
- AI model selected (Sora 2, Veo 3)
- Resolution and quality settings

Credit Usage

Credits are consumed when video generation is initiated
Failed generations may result in partial or full credit refunds at our discretion
Credits are non-transferable between accounts
Unused credits do not roll over between billing periods (monthly plans)

Usage Restrictions

Free plan users can generate 1 video at a time
Pro and Lite users may have higher concurrent generation limits
We reserve the right to implement fair usage policies to ensure service availability for all users

Subscription Plans and Payments

Billing Terms

Subscription fees are billed in advance on a monthly or annual basis
All payments are processed securely through our payment partner, Stripe
Prices are subject to change with 30-day notice to active subscribers
You authorize us to charge your payment method for recurring subscription fees

Automatic Renewal

Subscriptions automatically renew at the end of each billing period
You can cancel automatic renewal at any time through your account settings
Cancellation takes effect at the end of the current billing period
No refunds for partial billing periods (see Refund Policy for exceptions)

Payment Failures

If payment fails, we will attempt to process it again
Continued payment failures may result in service suspension
You are responsible for maintaining valid payment information

Price Changes

We may change subscription prices with 30-day advance notice
Price changes apply to subsequent billing periods
You may cancel before the price change takes effect

Refund Policy

Monthly Plans: 7-day refund window, maximum 5 videos generated
Annual Plans: 14-day refund window, maximum 10 videos generated

Generated videos will be removed upon refund approval

Acceptable Use

You may use ASMR AI Studio to:

Generate ASMR videos for personal enjoyment and relaxation
Create content for educational purposes
Produce videos for commercial use (Pro and Lite plans only)
Experiment with different ASMR styles and templates
Share your creations with the community (when appropriate)

Prohibited Content

You may not create videos that contain:

Hate speech, discrimination, or harassment based on race, religion, gender, sexual orientation, disability, or other protected characteristics
Violence, gore, or content intended to shock or disgust
Illegal activities or promotion of illegal substances
Content that violates others' copyrights, trademarks, or intellectual property
Misleading or deceptive content designed to harm others
Spam or repetitive content intended to manipulate algorithms

Content Moderation

We reserve the right to review generated content for compliance with these guidelines
Violating content may be removed without notice
Repeated violations may result in account suspension or termination
We may report illegal content to appropriate authorities

We make no warranties about the accuracy, completeness, or suitability of generated videos

You are responsible for reviewing and approving generated content before use

Service Availability and Modifications

Service Provision

ASMR AI Studio is provided on an "as is" and "as available" basis
We do not guarantee uninterrupted or error-free service
Service availability may be affected by:
- Scheduled maintenance
- Technical issues or server problems
- Third-party service disruptions (AI model providers, cloud services)
- High demand or traffic spikes

Service Modifications

We reserve the right to:

Modify, suspend, or discontinue features with reasonable notice

Maintenance and Downtime

Termination

Cancellation takes effect at the end of your current billing period

You may download your videos before account closure

We may suspend or terminate your account immediately, without prior notice or liability, if:

Your account poses a security risk to our platform or other users

Effects of Termination

Upon account termination:

Your generated videos may be deleted after a grace period

Outstanding payment obligations remain due

No Quality Guarantees: We do not warrant the accuracy, completeness, or quality of generated videos
No Uptime Guarantees: We do not guarantee uninterrupted or error-free service availability
No Compatibility Guarantees: We do not warrant compatibility with all devices, browsers, or software
No Fitness for Purpose: We do not guarantee that the service will meet your specific creative or commercial requirements
No AI Model Guarantees: We do not warrant the performance, availability, or results of third-party AI models

While we strive to provide high-quality AI video generation services, we cannot guarantee specific outcomes or results.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASMR AI STUDIO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

Use of or inability to use the service
Generated videos that don't meet your expectations or requirements
Technical issues, service interruptions, or data loss
Third-party claims related to your generated content
Unauthorized access to your account or data
Errors, bugs, or defects in the service
Loss of profits, revenue, data, or business opportunities

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless ASMR AI Studio, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
